Vistafolio, Inc. ("Vistafolio.com") cares about your privacy and takes special efforts
to maintain your trust. Vistafolio.com hosts a variety of photographic entries and
correspondences authored by users who agree to submit such entries and correspondences
(the “Artists”) to specifically assigned Web pages on www.Vistafolio.com, and non-registered
users who view such entries and participate in such correspondence with Artists
and other users (collectively, the “Visitors”).
This document provides a thorough description of Vistafolio.com's practices to help
you understand Vistafolio.com's approach to privacy. You should carefully read this
Privacy Policy (the "Policy"). If you have any questions about this Policy, email
privacy@Vistafolio.com.
This Policy supplements the Terms of Service ("Terms"). Thus, this Policy is incorporated
into and governed by all of the terms of the Terms. In the event of any conflict
between the terms of the Terms and this Policy, the terms of this Policy shall control.
This Policy applies only to information collected on the Vistafolio.com Web site.
It does not speak about Vistafolio.com's practices for information collected elsewhere
or the practices of any third parties, including those who operate sites on Vistafolio.com's
behalf and that display Vistafolio.com’s branding.
INFORMATION WE COLLECT
We collect information about you through the use of cookies and IP addresses, registration
as a Visitor or Artist and through correspondence.
1. Cookies and IP Addresses. When you visit our site, Vistafolio.com may
collect information about you and your visit through cookies and IP addresses and
by analyzing what URLs you came from and go to.
A cookie is a small piece of information stored by a Web site on your computer's
hard drive. Cookies are extensively used by Web sites as a convenient way to store
information about your visit to such Web site. If you have not registered, cookies
help Vistafolio.com understand the site better and target ads based on whatever
information Vistafolio.com knows about you (which isn't much if you have not registered).
Most browsers allow you to configure your preferences to notify you when cookies
are being placed on your hard drive or to reject all cookies. Rejecting cookies
will not noticeably affect your experience as an unregistered visitor.
An IP address is a number that is automatically assigned to your computer when you
use the Internet. In some cases your IP address stays the same from browser session
to browser session; but if you use a consumer Internet access provider such as AOL
or Earthlink, your IP address probably varies each session-thus making it difficult
for Vistafolio.com to use your IP address (by itself) to determine whom you are.
When you visit the site, Vistafolio.com servers log your IP address, which is used
for, among other things, systems administration and aggregated usage reports.
Some of the banner advertisements displayed on the Vistafolio.com site are provided
by outside companies. These banner advertisements may contain cookies that will
be placed on your computer. We cannot control their use of cookies or how they will
use the information we gather.
2. Registration on Vistafolio.com. The Vistafolio.com site is optimized for
registered users. If you register, Vistafolio.com uses cookies and IP addresses
as described above. In addition, Vistafolio.com uses cookies to store your preferences
and passwords for your convenience, to provide you with a more personalized experience,
and to track your use of the site. You must accept cookies to access the site as
an Artist.
When you register, Vistafolio.com asks you for contact and demographic information.
Vistafolio.com uses registration information internally for a number of purposes,
including:
- Email Distribution. As described in the Terms and for administrative purposes (such
as to notify you about changes to the
Terms or this Policy). In accordance with instructions on the site, you may opt
not to receive certain emails in the future, and
Vistafolio.com will use reasonable efforts to honor your request.
- Email Notifications. In a number of places, Vistafolio.com provides the option to
receive an email when an activity occurs. For
example, you can choose to be emailed if a specific Artist uploads new photographs.
If you choose to be notified in such
instances, that Artist may be able to see your message.
- Display banner (and similar) advertising to you in connection with the site that
is more targeted to you specifically. In doing
this type of targeting, Vistafolio.com or its ad server, and not the advertiser,
connect you with the targeting criteria.
3. Artist and Visitor Correspondence. Vistafolio.com provides a forum for
Artists to post their photographs and comments ("Content") and for Visitors to view
such Content and communicate with Artists and other Visitors (collectively “Correspondence”).
Personal information you include in Correspondence may be used by Artists, who will
also have available to them any information that you send them directly. Artists’
use of this information is bound by the principles and practices expressed here.
Any information, including personal information disclosed in Correspondence is public
and is not subject to our privacy policy as described in this Policy. Please be
aware that if you voluntarily disclose information online, personal or otherwise,
that information can be collected and used by others. For example, if you post personal
information online you may receive unsolicited messages from others. Vistafolio.com
will have no means to control this.
4. Additional Information. In addition to the above, we may also collect
personal information about you that you provide through communications to us, such
as an email requesting customer service or that third parties provide, such as a
complaint about you from another Artist or Visitor.
5. Corrections and Updates to Your Personal Information. You may review your
personal information at any time and you may change or correct selected personal
information about yourself.
6. Canceling Your Registration and/or Deleting Your Personal Information.
You may cancel your registration to the site or request the removal of your registration
information from our records by emailing privacy@Vistafolio.com. Vistafolio.com
will send you an email to confirm your request. After you respond, Vistafolio.com
will remove your information from its "live" database, but residual information
may remain in archives and records. Vistafolio.com may not be able to propagate
changes to your registration information to third parties who have received such
information as described below. In addition, if your account is being terminated
for violations of the Agreement, Vistafolio.com may keep some of your registration
information active to prevent re-registration.
WHO HAS ACCESS TO AND CAN USE INFORMATION WE COLLECT
1. Contractors and Third Party Service Providers. Vistafolio.com uses contractors
to help with its operations. Some or all of these contractors may access the databases
of user information. Usually these contractors will enter into an Agreement that
places restrictive provisions on their use and disclosure of all information they
obtain through the relationship.
Vistafolio.com also uses third party service providers to help with certain aspects
of its operations that may require disclosure of your personal information to them.
Vistafolio.com will usually place extensive restrictions on the ability of these
third parties to use and disclose your personal information except as necessary
to perform the services that they are asked to perform.
2. The "Corporate Family." Although Vistafolio.com currently does not have
a parent company, any subsidiaries, joint ventures or other companies under a common
control, it might in the future. In these cases, Vistafolio.com would expect to,
and may, share some or all of your information with these other companies, in which
case Vistafolio.com will ask such entities to honor the promises in this Policy.
In addition, as part of a diligence review, Vistafolio.com may disclose some or
all of your personal information to a potential acquirer or merger partner, although
in this case Vistafolio.com would restrict their use and disclosure of this information.
3. Government Relations and Lawsuits. In some cases, the government can compel
the disclosure of information about you, and of course Vistafolio.com will need
to comply. However, irrespective of those situations, Vistafolio.com can unilaterally
turn over information about you to the government if it believes such disclosure
to be appropriate, in which case you authorize it to do so. You also consent to
Vistafolio.com disclosing information about you to actual or potential parties to
a lawsuit that Vistafolio.com is or may become involved in (a) if it is required
to do so, (b) if it reasonably believes that such disclosures will potentially mitigate
its liability, or (c) to enforce its rights.
WHAT WE DO WITH THE INFORMATION WE COLLECT
1. Demographic Information. Vistafolio.com collects general demographic information
about users who register as Artists. We use the personal information that we collect
about our Artists so that we may communicate with such users, as described above,
and to provide such users with specifically targeted advertisements.
We produce aggregate reports for advertisers. For example, we tell advertisers how
many people saw or clicked on an ad and additionally, how many people saw or clicked
on ads in different portions of our service. Where available, we may offer additional
information about viewer characteristics. However this does not include personally
identifiable information or online usage patterns. Our advertisers allow us to provide
our service to our users and our members. In return, they need to know how to effectively
place their ads to potential customers.
2. Integrated Services. Although Vistafolio.com doesn't currently offer any
integrated services operated by third parties, Vistafolio.com may do so in the future.
If we do offer an integrated service operated by a third party and you choose to
use these services, the integrated service may request that personal information
you have provided to Vistafolio.com be released to the integrated service. Vistafolio.com
will notify you before allowing you to use a third party integrated service so that
you may make a decision at that time if you want the information to be released.
If you do want your information released, Vistafolio.com may transfer some or all
of your registration information and other information to the third party to operate
the integrated service if you choose to use these services.
3. Internal Analyses and Reports. Vistafolio.com uses all of the information
in its databases, including personal information you've submitted, your transactional
experiences, and other server and usage logs, to analyze the site and user behavior,
troubleshoot technical problems, resolve disputes and address complaints, and prepare
aggregated reports that are shared with others.
4. Other Uses of Information. Specific uses of personal information that
vary from this Privacy Policy (if any) may be found throughout the site. When you
receive notification that specific information that you submit to the site will
be subject to privacy practices which are different from those described in this
Privacy Policy, you will be informed of those alternative privacy practices prior
to the submission of the information and those alternative disclosures will govern
that submission.
There may be situations where Vistafolio.com collects data through a survey or similar
process when the page does not link to this Policy. In those cases, unless you are
informed otherwise, you should assume that Vistafolio.com’s privacy policy as expressed
in this Policy applies to such data.
ADDITIONAL NOTICES
Collecting Personal Information from the Site. Vistafolio.com wants the community
to be vibrant and engaged. Thus, Vistafolio.com is delighted when users begin communicating
with each other outside the context of the site. However, not every user wants to
engage in these types of dialogues, and Vistafolio.com believes each user should
have the right to set the boundaries that feel right to them. Thus, you may not
collect, use or store any personal information about other users on the site for
any purpose whatsoever unless the user invites you to do so. Thus, if a user displays
an email address in any Content or Correspondence, you can assume that the user
is willing to receive a single personal email from you that has some relation to
the site. However, without that user's permission, you may not contact the user
about something that has nothing to do with Vistafolio.com, store that user's contact
information in a database for further communications, or continue to contact the
user if they have requested you not to. In all circumstances, as described in the
Terms, you may not use robots, scripts or other automated procedures to collect
any information, including user contact information, from the site. You also may
not email users inviting them to join your own online journal site under any circumstance
– doing so is a theft of Vistafolio.com's valuable rights and an affront to users.
Vistafolio.com will protect its interests very vigorously in this regard.
Limits on Vistafolio's Abilities. A site and service as complicated as Vistafolio.com
is never perfect, and thus Vistafolio.com may inadvertently make uses or disclosures
of your information in ways not contemplated by, or in direct contravention of,
this Policy. Vistafolio.com might also make ad hoc uses of your information in ways
it can't contemplate here. Vistafolio.com will do its best to work with you if these
types of situations arise, but your sole remedy in these cases is to have Vistafolio.com
try to rectify the problem as soon as it can.
In addition, although highly unlikely, it is possible for Internet transmissions
containing your personal information to be intercepted by others. It is impossible
for Vistafolio.com to ensure the privacy and security of all transmissions made
to and from the site while in transit.
Of course, Vistafolio.com does not control the privacy practices of its advertisers
and other third-party sites that it promotes or links to. If you click through a
banner ad or link and submit your information to an advertiser, you will be subject
to their privacy policies. Please make sure you understand these policies before
submitting your information.
CHILDREN’S PRIVACY
Vistafolio.com feels strongly about protecting the privacy of children and encourages
kids to involve their parents in any interactive activity they participate in online.
We will place prominent notice wherever personally identifiable information is collected
requesting the child to ask a parent for permission to proceed.
We will not collect online information from a user under 13. We will also not:
- collect personally identifiable offline contact information from users under 13
without prior verifiable parental consent.
- distribute to third parties any personally identifiable information collected from
a child under 13 without prior verifiable
parental consent.
- give children the ability to send e-mail, create personal web pages, participate
in forums or kids chat rooms without prior
verifiable parental consent.
- entice a child under 13 by the prospect of a special game, prize or other activity,
to divulge more information than is needed to
participate in such activity.
The following are details of the information we collect and how we use it:
- We collect general usage information about visitors to our Web site through the
use of cookies and IP addresses. A cookie

cookies received through banner ads are collected by our advertisers and we do not

access to this information. Cookies in and of themselves do not contain any
personally identifiable information about your child.

COPPA
Because we care about the safety and privacy of children online, we comply with
the Children's Online Privacy Protection Act of 1998 (COPPA). We offer the following
for the protection of children under 13:
Participation as an Artist or Visitor of Vistafolio.com requires initial registration
and the collection of information. Children under 13 may not register as an Artist
or Visitor.
This site is operated by Vistafolio, Inc. We are the only operator that collects
